Terms of Service

1. Acceptance of Terms

By downloading, installing, or using any mobile or web application published by NabTech LLC (collectively, the "Application"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Application.

The Application is operated by NabTech LLC ("NabTech", "we", "us", "our"). These Terms constitute a legally binding agreement between you and NabTech.

2. Description of Service

NabTech develops and publishes mobile and web applications across various categories including fitness, health, productivity, and lifestyle. Our Applications may be offered:

Directly under the NabTech brand or a NabTech-owned brand (e.g., GYMZO).
As white-label products under a business partner's brand name.
Through the Apple App Store, Google Play Store, or other distribution platforms.

Regardless of branding or distribution channel, these Terms apply to your use of the underlying Application and Service.

3. Account Registration

Some of our Applications require you to create an account. If so, you agree to:

Provide accurate and complete registration information.
Maintain the security of your account credentials.
Notify us immediately of any unauthorized use of your account.
Accept responsibility for all activities that occur under your account.

You must be at least 13 years old to use our Applications. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. Subscriptions and Payments

4.1 Pricing

Some Applications offer premium features through paid subscriptions. Pricing, subscription tiers, and free trial periods are displayed within each Application and may vary by region and platform.

4.2 Billing and Renewal

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can manage and cancel your subscription through your device's app store settings (Apple App Store or Google Play Store).

4.3 Refunds

Refund policies are governed by the app store through which you purchased the subscription. Please refer to Apple's or Google's refund policies for details.

5. User Conduct

You agree not to:

Use the Application for any illegal or unauthorized purpose.
Attempt to reverse engineer, decompile, or disassemble the Application.
Interfere with or disrupt the Application or servers connected to the Application.
Create multiple accounts for fraudulent purposes.
Share your account credentials with others.
Upload or transmit harmful, offensive, or inappropriate content.
Use the Application to harass, abuse, or harm other users.

We reserve the right to suspend or terminate your account if you violate these Terms.

6. Health and Fitness Disclaimer

Important: Some of our Applications provide fitness tracking, health-related features, or wellness content. These Applications are informational tools, not medical devices or services. Any workout plans, exercise suggestions, health data, or wellness content provided through our Applications are for informational purposes only and do not constitute medical advice, diagnosis, or treatment.

Always consult a qualified healthcare professional before beginning any exercise program or making health-related decisions, especially if you have pre-existing health conditions, injuries, or concerns.

You acknowledge that physical exercise and health activities carry inherent risks, including the risk of injury. You use our Applications and act on any information within them at your own risk. NabTech is not responsible for any injuries, health issues, or damages resulting from your use of our Applications.

7. Intellectual Property

Our Applications, including all content, features, designs, software, and trademarks, are owned by NabTech LLC and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Application for personal, non-commercial purposes.

You may not:

Copy, modify, or create derivative works based on the Application.
Use our trademarks, logos, or branding without written permission.
Reproduce or redistribute any part of the Application.

8. Third-Party Content

Our Applications may display content provided by third parties, including organizations, professionals, or other users. We do not guarantee the accuracy, completeness, or safety of third-party content. You interact with third-party content at your own risk.

9. Disclaimer of Warranties

Our Applications are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that any Application will be uninterrupted, error-free, or free of harmful components.

To the maximum extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, NabTech LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, personal injury, or property damage, arising from your use of our Applications.

Our total liability for any claim arising from or related to the Application shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

11. Termination

You may stop using the Application and delete your account at any time. We may suspend or terminate your access to the Application at any time, with or without cause, with or without notice.

Upon termination, your right to use the Application ceases immediately. Sections 6 (Health Disclaimer), 9 (Disclaimer of Warranties), 10 (Limitation of Liability), and 12 (Governing Law) survive termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Israel, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved exclusively in the courts located in Israel.

13. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Effective Date" at the top of this page and notify you through the Application or via email for significant changes.

Your continued use of our Applications after any changes indicates your acceptance of the updated Terms.
